Beton par nature Warranty Information
Beton par nature warrants its products against any defects in manufacturing and materials for a period of two years from the original shipping date, provided that the product is used in the manner and under the conditions for which it was designed.
"Seller", "we", "our" refers to the company Béton par nature.
"Buyer" or "you" refers to the person or company named in the invoice, order, or quote and, in the case of an individual, their executors, administrators, and assigns, and in the case of a company, its successors and assigns.
"Invoice" refers to the billing document issued by the seller or its authorized agent to the buyer.
"Order" refers to the confirmed agreement between the seller and the buyer for the sale of goods, effective upon the issuance of an order number or documented by an invoice.
"Residential" refers to normal residential domestic use, including houses and residential apartments.
"Commercial" refers to all non-residential purposes, including, without limitation, hotels, schools, nursing homes, hospitals, clubs, and student housing.
"Wear and Tear" refers to the normal degradation of the product resulting from regular use, not covered by this warranty, including minor scuffs, scratches, or chips that do not affect structural integrity.
"Structural Defect" refers to a defect affecting the function or structure of the concrete basin, covered by the warranty if it is due to material or manufacturing defects. This excludes natural characteristics such as, but not limited to, patina, color variations, pinholes, or texture.
Scope of Warranty
This warranty agreement is entered into between the Seller and you, the person, organization, or entity purchasing products or associated services from us, hereinafter referred to as the "Buyer". The terms of this warranty apply to all sales made by the Seller to the Buyer.
The Seller warrants the products to the original Buyer, starting from the delivery date. Under this warranty, our liability is limited to offering the following remedies:
- Repair of the structurally defective product or part.
- Replacement of the structurally defective product or part.
- Provision of an equivalent product or part (shipping costs not included).
These remedies will only be offered if we are convinced that the loss or damage was due to a structural defect in the product or part. The proposed solution remains at the discretion of the company Beton par nature.
Terms of Sale
- Acceptance of terms: by placing an order, you ("the buyer") agree to follow the terms described in this warranty and the sales contract, as well as any additional terms on the Beton par nature website
- Purchase confirmation: your agreement with us ("the seller") becomes official when we assign you an order number.
- Production and shipping: you acknowledge that you understand the details related to the time required to produce your items, the duration of their transport, additional shipping costs, and other relevant details. This information may be communicated to you verbally or in writing.
- No returns for change of mind: all our products are made to order. Therefore, you cannot return or exchange items simply because you have changed your mind.
- Nature of natural material: When you place an order, you agree that our concrete basins are handmade and made from natural materials. This means that each basin will have its own unique appearance, including variations in color, small surface holes, and texture. These are not defects and will not affect the functionality of the product.
- Inspection of goods: After receiving your items, please inspect them immediately. If you notice any discrepancies in quality, quantity, or product description, you must notify us in writing at contact@betonparnature.fr within 48 hours of delivery. Please note that any item arriving visibly broken or shattered but not inspected at the time of delivery will be the responsibility of the customer.
- Warranty limitations: The warranty applies only to the original buyer and is not transferable.
- Warranty start date: Your warranty starts on the delivery date of the product.
- Our right to accept or reject orders: We reserve the right to accept or reject your order for any reason, for example, if the product is unavailable or if there is an issue with payment validation.
- Order confirmation: we will confirm your order by providing details such as the order or invoice number, shipping and billing addresses, and a description of the products you are purchasing.
- Responsibility for order details: You are responsible for verifying all order details, including product specifications and prices, before making a deposit or full payment.
- Limitation of liability: To the extent permitted by law, you acknowledge and agree that the seller will not be liable to you, any user of our products, or any third party:
- for any injury or illness suffered resulting from or related in any way to the installation or use of our products;
- for any failure on your part to meet any of your legal obligations under any health and safety legislation, any duty of care owed by law or similar, including, but not limited to, a failure on your part to take necessary precautions and care regarding the installation or use of our products
- with regard to any direct, indirect, punitive, incidental, special, or consequential loss or damage (including damages for loss of use, opportunity, or profits).
Warranty Exclusions:
Installation and use
- Unlicensed installation: products not installed by a licensed tradesperson or in violation of installation guidelines.
- Non-compliance with standards: installation not in accordance with the accompanying installation instructions.
- Incorrect applications: use of products for purposes not intended.
- Poor installation practices: issues originating from installation, such as incorrect sealing or overtightening of drains and traps.
- Defects caused by third parties: defects attributable to installation, modification, cleaning, or repair performed by any party other than the manufacturer.
Care and maintenance
- Inadequate maintenance: Products not maintained in accordance with our care recommendations or that have been accidentally damaged.
- Inappropriate cleaning: Damage caused by the use of cleaning agents other than warm water, natural Marseille soap, and a clean microfiber cloth.
- Poor handling and environmental damage: poor handling, accident, fire, lightning, other natural or man-made hazards, or during transport.
- Inappropriate use: includes, but is not limited to, damage due to poor handling, excessive heat, exposure to uneven weather conditions, and improper maintenance and care.
Physical and structural damage
- Impact damage: chips or other excessive impact damage to the product.
- Scratches: concrete and sealants are abrasion-resistant, but not scratch-proof; scratches caused by natural use are not covered by the warranty.
- Water damage: to sinks or any concrete surface due to scratches and natural wear.
- Thermal shock: Thermal shock can occur causing cracks over a prolonged period, leading to a risk of damage. Please note that damage resulting from thermal shock is not covered by our warranty.
- Excessive pressure: damage caused by weight or pressure when applying force considered outside of normal use.
- Coating failure: the Beton par nature surface protection becomes immediately void if compromised by scratches, heat, chemicals, chips, drops, accidents, poor installation, or commercial and/or public use.
- Prolonged exposure to water: Our basins must be installed with free-flowing drains. Beton par nature basins must not be immersed in standing water at the risk of damaging the product.
Natural variations
- Warning regarding colors and textures: colors and textures may differ from photos. We recommend purchasing samples to ensure the product meets your expectations
- Character over time: Your basin will age naturally, acquiring unique characteristics that enhance its beauty. By purchasing our products, you acknowledge and accept these natural variations.
